1-OBJECT
These Terms of Use and General Conditions have as their object the purchase of Beer & Wine s.r.l. (hereinafter also “Seller” and / or “BEERWINE”) carried out remotely through the website www.fermentiamo.it belonging to:

Purchases made on the site www.fermentiamo.it (hereinafter also referred to as the “site”) are reserved for direct user customers. Each purchase operation on the site will be governed by the provisions of Legislative Decree n.206 / 2005 (amended by Legislative Decree 21/14 and Legislative Decree 70/03) and as regards the protection of confidentiality, it will be subject to the legislation national pursuant to Legislative Decree no. 196/03 and the European legislation referred to in Reg. 679/2016.
2- PURCHASE ON THE INTERNET SITE
The Customer has the possibility to acquire the products available on the site either by registering (creating his own account) or without registration.
3- REGISTRATION

Once the aforementioned data has been entered, the Customer directly enters and confirms the password chosen by him and activates the account.

4- PRODUCT SELECTION PROCEDURE AND CONTRACT CONCLUSION
Below is the procedure for selecting the product / products and the conclusion of the purchase contract:
By browsing the site, the user will be able to view the products offered by the seller and by selecting one of them, he will be able to view the price, its description, the technical information relating to the product.

The Customer can also enter the products within the Wishlist
The selected products can also be removed from the Cart and from the Wishlist;
Once the Customer has chosen the products for which he wants to proceed with the purchase and entered his data in the relative form 1- BILLING ADDRESS and selected the payment method referred to in section 3- PAYMENT METHOD, he must select the function ” Complete the order ”adding the billing address (if the invoice is requested) and shipping address, in this way the Customer will access an area where he can see the order summary;
It will also be possible for the Customer to enter a promotional code with the appropriate “Apply” function
To proceed with the order, the Customer must enter their contact details in the form 1- BILLING ADDRESS (name, surname, E-mail, telephone, address, city and post code), failure to enter even one of the aforementioned data will not allow you to proceed with the purchase. The customer can also request the invoice (“I want the invoice” or select “I do not want the invoice”), it will also be possible to save their data for subsequent orders using the “Save your data for future orders” function and finally indicate a address different from that indicated in the aforementioned form.
Once the “Complete the order” button has been selected, the seller will send the order receipt (with summary of the products purchased, receipt / order confirmation with purchased products and payment information) to the email indicated in the form by the Customer. This summary will also be available in your private area in the case of a registered User.
5- METHOD OF PAYMENT
In section 3 – PAYMENT METHOD decide the payment methods (credit card, paypal1, advance bank transfer), before completing the payment, the customer can read the Privacy policy of the site and will be invited to read and confirm the reading of the Privacy Policy.
The payment data (and / or payment method used will not be saved, archived and / or registered on the site by the Seller but will be managed only by PayPal (both in the case in which payment is made by credit card or in case of use of the PayPal card).
6- FURTHER INFORMATION ON THE ORDER AND PAYMENT
When the Customer places an online order for the products he has placed in the cart, he agrees to purchase them at the price and terms indicated in these E-COMMERCE TERMS OF USE AND SITE CONDITIONS OF SALE (hereinafter also just “Conditions”) . However, Beerewine reserves the right not to accept the order, at its discretion, giving reasons to the Customer for the aforementioned choice.
7- OBLIGATIONS OF THE CUSTOMER
These Conditions must be examined online by the Customers before sending their orders.
The Customer will be required and obliged to pay the price once all the data required in the order procedure described above has been entered.
8- PRICES
The prices of the products indicated in the various sections of this site include VAT (which will be indicated in the order confirmation).
The prices applied to each sale are those indicated on the site at the time of the order by the Customer.
The price of the products purchased, together with the cost of home delivery, must be paid by the Customer at the time of the online order, by credit card, paypal or bank transfer in advance.
Tax documentation will be issued by BEEREWINE upon delivery, by issuing a receipt.
The Seller is not responsible for any fraudulent or illegal use that may be made by third parties of credit cards upon payment of the purchased products.
In the event that the prices are reported in a clearly discordant way (both excessive and decreasing), the order may be canceled at any time by the Seller or the Customer. However, it will be possible to reorder the products at the correct selling price. In the event that, for any reason, a lower price is incorrectly indicated for a particular product, there is no obligation on the part of the Seller to provide the aforementioned to the Customer.
The prices shown on this site are the sales prices currently in force and may be subject to variations. The price variation does not affect orders already confirmed.
The prices of the products are those that appear on the site, unless there is an obvious error.
9- BILLING
To obtain the invoice, it is necessary to request it at the time of purchase, indicating the company name, VAT number, sdi box or certified mailbox at the time of ordering and making an express request by selecting the appropriate box.
The invoice will be issued when the goods will be the shipped and sent with the goods.

10- LEGAL GUARANTEE OF CONFORMITY
The products purchased on www.fermentiamo.it have legal guarantee of conformity of the goods, articles 128 et seq. Consumer Code. The legal guarantee is valid for two years and must be enforced by the consumer within two months of discovering the defect.
11- SHIPMENTS AND DELIVERIES
Fermentiamo, by express couriers, delivers the products ordered by the customer to the address indicated by the customer on the purchase order. Shipping costs based on the type of customer ( “private” or legal person “company”)

The delivery times indicated are purely indicative and are in no way mandatory.
Once the products have been delivered by the courier, the Customer is required to check:
The number of packages covered by the order;
Integrity of the packaging and that it is not damaged, wet, altered and that the sealing materials (adhesive tape or metal straps) are not tampered with.
Any damage or the mismatch in the number of packages or information must be immediately reported to the courier making the delivery, adding the wording “Goods control reserve” on the appropriate accompanying document and communicated to the assistance email of the Site info @ fermentiamo .it.
If the customer does not sign with reserve, the courier will consider the delivered package as intact in all its parts, therefore it will be impossible to activate a dispute / refund procedure against the courier itself and BEEREWINE.
12- DISCOUNTS, AND PROMOTIONAL CODES
The Seller reserves the right to evaluate the possibility of granting discounts or promotional codes on the products published on the site.
13- RIGHT OF WITHDRAWAL
The right of withdrawal is governed by art. 52 of Legislative Decree no. 206/2005 and allows the Customer to have the right to withdraw from the purchase contract for any reason (including product / goods damaged or different from the one selected through the online purchase procedure). To exercise this right, the Customer must send a communication within 14 working days from the date of receipt of the product.

a) Withdrawal procedure
The right of withdrawal must be exercised in the following ways:
The right of withdrawal must be exercised within 14 days of delivery of the product, within this communication the Customer must include the following information:
a) the order number;
b) the product (s) for which it intends to exercise the right of withdrawal;
c) the reasons for which it intends to exercise the right of withdrawal;

e) photo of the item received
The Customer must also attach the relative receipt included in the delivered package to the aforementioned communication.
Failure and / or partial and / or omitted attachment and / or indication of the aforementioned information will not allow the seller to respond to the request for withdrawal made by the Customer.

The product must be returned and received at the address indicated in the previous point no later than 14 days from the communication of the withdrawal by the Customer, under penalty of forfeiture of the right and / or inability to exercise the right of withdrawal;
The dispatch of the goods, until the notification of receipt of the same (and relative verification of the original packaging and its contents), is under the sole responsibility of the Customer;
As an alternative to the procedures for exercising the right of withdrawal and return of products, customers who have benefited from delivery to the point of sale for the product for which they intend to withdraw can, after exercising the withdrawal within the aforementioned period, return the product at the point of sale.
If the goods are damaged as a result of transport, the Seller will notify the Customer (within 10 days of receipt of the goods), to allow him to file a complaint or other suitable action against the courier used / postal service and obtain reimbursement of the value of the asset; in this case, the product will be made available to the Customer for its return, at the same time canceling the request for withdrawal;
FERMENTIAMO is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;
The refund will be made based on the payment method made at the origin (bank transfer, Paypal and reversal of the amount paid by credit card), within 30 days of receipt of the product by Beerewine.
The Customer, as an alternative to the refund of the purchased products and upon his specific request, can obtain a voucher or voucher of the same amount.
The refund and / or voucher do not include shipping costs and / or any additional costs incurred by the Customer.
Do not send goods on delivery as it would be rejected.
14 – EXCLUSIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal is excluded in the cases provided for by art. 59 of the Consumer Code, this article also provides that the right of withdrawal cannot be exercised in relation to all those goods that risk deteriorating and expiring rapidly, the supply of sealed goods that are not suitable to be returned for hygienic reasons or related to health protection.
Beerewine further does not allow the exercise of the right of withdrawal in all cases in which the products have been processed and / or semi-finished by the Customer.
15 – PRIVACY LEGISLATION
We inform you that, pursuant to the legislation on the protection of personal data contained in Legislative Decree 196/2003 as amended by the EU Reg. 2016/679 (“GDPR”), the personal data provided when registering on this site are necessary in order to follow up on your request to ship the products and for any billing of the order.
In case of failure to provide the data, the order will not be processed.

16 – COMPLAINTS
Any complaints must be addressed directly to BEERWINE after contacting customer service or e-mailing the dedicated address info@fermentiamo.it within 15 days of receipt of the goods. BEERWINE undertakes to respond to complaints within a reasonable time from the date of the request.
17 – APPLICABLE LAW AND JURISDICTION
The sales contract between the Customer (both natural and legal person) and BEERWINE is concluded in Italy and governed by Italian law.
For customers who are natural persons, in the event of disputes relating to the validity, interpretation or execution of the same contract, the territorial jurisdiction is of the judge of the place of residence or domicile of the consumer, if located in the territory of the State.
For Clients legal persons who have purchased the seller’s products and consequently adhered to these conditions of sale, it is foreseen, and is expressly confirmed and accepted by the Clients, that for any future dispute arising from this agreement, or connected to it , the Court of Parma is competent.
- The transaction is not carried out on the Site but on the secure and protected Paypal site / web page. The Seller does not register the codes of the Credit Cards used on its Site. The code is used only for the payment transaction and within the Paypal interface. At no time during the purchase procedure by credit card, the Seller is able to know personal information relating to the holder of the same, as the data relating to the credit card are not collected and / or stored by the Site. The information is transmitted directly to Paypal which manages the transaction. Beer & Wine cannot be held responsible for any fraudulent use of credit cards by third parties when paying for products purchased on its site.
- “Force Majeure Events” include situations resulting (directly or indirectly) from any strikes, lockouts, fires, floods, proven inability to procure products, materials or services, breakdowns, delays by suppliers or couriers, government laws or regulations or any other cause or event beyond our control.
